Meanwhile, months go by with zero transparency.

           Here is the part most beneficiaries do not realize: California law does not give your trustee a “just trust me” option. The right to a trust accounting is not a favor. It is a legal obligation, and if your trustee is refusing to provide one, the law gives you real tools to force compliance.

           What Is a Trust Accounting in California?
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

    &lt;span&gt;&#xD;
      
           A trust accounting is a formal financial report prepared by the trustee that lays out everything that happened with the trust’s money and property during a specific period. We are not talking about a one-page letter or a casual email with a few numbers. A proper trust accounting must include all income received, all expenses paid, every distribution made, gains and losses on investments, any compensation the trustee took for themselves, and the current value of remaining trust assets.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Think of it this way: if your parent or loved one left assets in trust for your benefit, the accounting is the document that shows you exactly where all of that money and property went. Without it, you are flying blind.
          &#xD;

           California Probate Code Requires Trustees to Provide Accountings
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           This is not a gray area. Under California Probate Code Section 16062, a trustee must provide an accounting to each beneficiary who is entitled to receive distributions at least once per year. This obligation is automatic. A beneficiary does not need to make a special request or beg for the information. The trustee’s duty to account kicks in the moment the trust becomes irrevocable, which in most cases is when the person who created the trust passes away.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

    &lt;span&gt;&#xD;
      
           On top of that, Probate Code Section 16060 independently requires the trustee to keep beneficiaries “reasonably informed” about the trust and its administration. That means even outside the formal annual accounting, the trustee cannot stonewall you. If you have asked reasonable questions about what is happening with the trust and you are getting silence or runaround, the trustee is likely already in violation of their fiduciary duties.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           A written demand from you can accelerate the timeline, but the trustee’s duty exists regardless of whether you ask.
          &#xD;
    &lt;/span&gt;&#xD;

    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           What Must a California Trust Accounting Contain?
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           Under Probate Code Section 16063, a trust accounting must be detailed enough to put the beneficiary on notice of all material facts necessary to protect their interest. At minimum, a proper accounting must include a statement of all receipts and disbursements of both principal and income, a statement of the trust's assets and liabilities as of the end of the accounting period, the trustee's compensation for that period, a list of any agents hired by the trustee, their relationship to the trustee (if any), and their compensation, a statement that the beneficiary may petition the court under Probate Code Section 17200 for review of the account, and a statement that claims for breach of trust must be brought within three years.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           I want to be clear about something, because this comes up constantly in our practice: a one-page summary letter from the trustee does not satisfy this requirement. Neither does a vague email with a couple of bank balances. The accounting has to be detailed enough for you or your attorney to identify whether something went wrong. If you cannot look at the document and understand where the money came from, where it went, and what is left, it is not a legally sufficient accounting.

          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;

    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           If the trustee will not voluntarily provide an accounting, you have real legal options under California law. Here is the playbook we typically walk our clients through.
          &#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

    &lt;strong&gt;&#xD;
      
           Step 1: Send a Formal Written Demand for Trust Accounting
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The first step is to put your demand in writing. Send the trustee a formal letter demanding a full trust accounting. We recommend sending it via certified mail with a return receipt so there is no question later about whether the trustee received it. This creates a documented paper trail that becomes important evidence if you end up in court. A verbal request at Thanksgiving dinner does not carry the same weight as a certified letter that cites the Probate Code sections.
          &#xD;

      &lt;br/&gt;&#xD;

           If the trustee ignores your written demand or refuses outright, the next step is filing a petition with the probate court under Probate Code Section 17200 asking the court to compel the trustee to produce a full accounting. The probate court has broad authority here, and in our experience, courts routinely grant these petitions. Judges do not look kindly on trustees who refuse to account for money that belongs to someone else’s inheritance.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           Step 3: Seek Attorney’s Fees from the Trustee
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Here is where it gets interesting for the trustee. Under Probate Code Section 17211(b), if the court determines that the trustee's opposition to the contest was without reasonable cause and in bad faith, the court may order the trustee to pay your attorney's fees and litigation costs. That is a two-part test: the trustee's conduct must lack both reasonable cause and good faith. The amount awarded is charged against the trustee's compensation or other interest in the trust, and the trustee is personally liable for any shortfall. This is a powerful incentive, and it is one reason why many trustees suddenly find a way to produce the accounting once a petition is filed.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           Why Trustees Refuse to Provide Trust Accountings
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           I will be direct about this, because after years of litigating these cases, a pattern becomes impossible to ignore: trustees who refuse to provide accountings are almost always trying to hide something. Sometimes it is self-dealing or outright misappropriation of trust assets. Sometimes it is excessive or unauthorized trustee compensation where the trustee has been paying themselves far more than is reasonable. Other times we see a failure to invest trust assets prudently, commingling of trust funds with the trustee’s personal accounts, or distributions to favored beneficiaries that fall outside the trust terms entirely.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The refusal itself is a red flag. A trustee with nothing to hide has no reason to resist transparency. If your trustee is dodging your requests, treating basic questions as personal attacks, or telling you that you “just need to trust them,” that is not a personality conflict. It is a warning sign that your inheritance may be at risk.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           Getting the Accounting Is Just the Starting Point
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Once you finally receive a trust accounting, the real work begins. You or your attorney should review it carefully for signs of mismanagement, self-dealing, or breach of fiduciary duty. If problems are found, the accounting itself becomes evidence that supports further legal action, including petitions for surcharge (meaning the trustee pays back what they lost or took), removal of the trustee, and recovery of trust assets.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           There is one critical timing issue every beneficiary needs to understand. Under Probate Code Section 16063(a)(6), a trust accounting must include a statement that claims against the trustee for breach of trust may not be made after three years from the date the beneficiary receives an account or report disclosing facts giving rise to the claim. This means that receiving an accounting starts a three-year clock. If you receive an accounting, shove it in a drawer, and forget about it for three years, you may lose your right to challenge what happened. Note also that some trust instruments contain their own limitation-of-claims provisions under Probate Code Section 16461, which can set shorter deadlines (though never less than 180 days). Ignoring an accounting can cost you your rights just as surely as never receiving one.

Finally, under Probate Code Section 16062(e), any waiver is void and against public policy where the sole trustee is a disqualified person under Probate Code Section 21380.

What is considered reasonable repair, or what is considered "clean?" What are acceptable payment methods? Therefore, the takeaway is to be as clear and precise as possible with all terms in the contract.

Clients also vary on how they want their estate handled if they are incapacitated for example, or how their pets are to be cared for, end-of-life decisions, and the list goes on and on. While an AI or software program can ask some of these questions, they will not read a client like an experienced attorney who will proactively investigate and inquire.

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

           For these reasons, AI often struggles with answering highly individualized questions. This is because AI thrives on generalizations since it gathers its data in the aggregate. This can be even more of a concern if the user is not savvy with AI. It’s often said in AI communities that an AI is only as good as the questions it's asked.

           I’d bet most users vastly different testimony regarding AI accuracy. Some may point to different AI versions or programs having varying levels of accuracy. Based on my experience, the accuracy is often correlated with the subject matter. The more general question, the more

           precise. Legal nuisances, partly grey areas, are where I have noticed the most struggles with AI accuracy.

           Like most of you, I’d wager that AI will become more accurate with time. However, will it ever be accurate enough to bet your estate on? I say this because even if an AI is 99% accurate, it may be that 1% that makes the difference. Remember that AI owes you no legal duty whereas an attorney is accountable for their work.

Another example is assigning an LLC to a trust or transferring a mobile home to a trust. Countless other actions would require action by an actual person, depending on the estate plan. Even with advancements in AI, this will not be possible.

    &lt;span&gt;&#xD;
      
           AI, like other tools on the internet, is suspectable to date/privacy breaches. This is even more concerning because data related to your estate plan is particularly sensitive, often documenting the most intimate aspects of your life. On a similar note, AI is in its infancy stage and things could change in the future. In the legal world, there are concerns as to the method of how AI gathers data. That is, it gathers data from other people's information on the internet. It's unknown how these copywriting concerns will change AI, if at all, in the future

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

           Recommended AI Uses

    &lt;/strong&gt;&#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In the legal field, AI can be useful to get baseline knowledge of a legal question or concept. Like a Google search, but often with more precision as it directly answers your question. An internet favorite prompt is to ask an AI to explain a difficult legal concept as if you were 12 years old (or younger). However, take caution, because AI is still very inaccurate.

           Proposition 19 was enacted in California at the end of 2020 and created substantial obstacles for homeowners to avoid reassessment of their property. This is significant because, under Proposition 13, property taxes are limited to 2 percent annually absent a change in ownership. This can be a massive benefit, particularly in California, where it’s common for homeowners to have purchased their property at a time when home values were much lower, and therefore, so would their property taxes. However, absent an exception, if there is a change of ownership under Proposition 13 the property would be reassessed.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In a nutshell, what Proposition 19 does is severely limit these exclusions. The current exclusions under Proposition 19 include victims of disasters, disabled persons, persons over 55 years of age, parent to child, and grandparent to grandchild.

           This exception is a huge benefit to those on fixed incomes. Particularly those near retirement age who want to downsize, but don’t want to be burdened with higher taxes. This applies only to one’s primary home. It can only be in California. This exclusion is limited to 3 transfers.

            This exclusion may be the most controversial since it is the most commonly used. This exclusion prevents reassessment only if the transfer is from a parent or grandparent to a child or grandchild and it is limited to the current taxable value plus one million. The last restriction is tricky. It requires that the child or grandchild make the property their primary home and do so within one year of obtaining it. That’s right, they actually have to move in. Renting it won’t suffice. Moreover, once you move out of the property it will be subject to reassessment.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

           Note that for the grandparent-to-grandchild exemption to apply, the parent(s) of the grandchild, who are the children of the grandparent, must have passed before the transfer.

  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           Other Proposition 19 Issues: LLC’s
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;

  &lt;p&gt;&#xD;

           Using an LLC to prevent reassessment can be a powerful tool, but not easy to implement. If a property is originally owned by the LLC then reassessment can be avoided as long as no new owner gains no more than 50 percent interest in the property
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           So what happens when you have a property and you later transfer it to an LLC? In this case, the rule is slightly different. If the property was originally individually owned and later transferred
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            to an LLC, then if the original owners transfer more than 50 percent in total, not
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           just at one time, the property will be reassessed.This can have huge tax implications For example, a commercial property that is subject to reassessment could have a property tax increase so significant that it's no longer worthwhile to keep. Therefore, planning ahead is critical.
          &#xD;
    &lt;/span&gt;&#xD;

  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

           Joint Tenancy
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Unfortunately holding title in joint tenancy does not help to avoid reassessment. While there is no reassessment after a single joint tenant passes, there will be once all the joint tenants pass.

           The transfer of a lease can also trigger a reassessment of a property. Each situation is unique, and some will favor having their spouse have complete control. Others may not want the risk that the plan will be changed after they’re gone and opt for a different kind of solution.

    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

           Gifts Outside the Trust
          &#xD;
    &lt;/span&gt;&#xD;

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           A strategy to consider is making gifts during your lifetime. This could include cash or anything else of value. However, there could be negative tax implications, such as capital gain taxes, depending on the gift. 
          &#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Assets could also be passed on through other accounts or insurance policies. Life insurance could be set up with the kids as the beneficiaries. Separate accounts, like a bank account could hold specified assets for children that can only be accessed after the parents' death, also known as a Pay on Death Account. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           An IRA can also be used to gift outside the trust by appointing beneficiaries. Normally, the default would be the spouse. However, appointing beneficiaries requires careful consideration because of the complexity of the Secure Act, along with tax implications and withdraw requirements.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The A/B Trust
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

However, the surviving spouse will have complete control of their trust, the A trust.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

    &lt;span&gt;&#xD;
      
           The downside is there is less flexibility for the surviving spouse, and it is more complicated to manage. For example, the B trust could allow income generated from the trust to the surviving spouse for their lifetime. However, this could be limiting and time-consuming to manage. It may also be limiting depending on the assets in the B trust. To mitigate this issue, the trust could be set up to allow for distribution of assets to the surviving spouse for their health, maintenance, and support during their lifetime. The downside to this approach is the trust assets have an increased chance that the assets will be depleted during the surviving spouse's lifetime. There are other tax potential benefits and implications for this type of trust. These should be carefully evaluated.
          &#xD;

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
